Terms of Service

These Terms of Service ("Terms") govern your use of the Fabulinus website and applications (the "Service"). By accessing or using the Service, you agree to these Terms, our Privacy Policy, and any referenced policies (e.g., Community Guidelines, Honor Code).

2. Definitions
- Consumer (Потребител): a natural person acting outside trade/business/profession
- Digital content / digital service: the app functionality and any digital learning content delivered electronically
- Subscription: paid plan that unlocks features or limits
3. Eligibility and Accounts
The Service is generally intended for users 14+.
For personal data processing of children, Bulgarian rules set the "digital consent" age at 14; if you are under that age, a parent/guardian must consent where required (see Privacy Policy).
You agree to provide accurate registration information and keep your account secure. Accounts are personal; do not share credentials.
4. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, educational purposes, subject to these Terms.
5. User Content (Flashcards, Categories, Uploads)
If you create, upload, or share content (e.g., flashcard sets, media, links) ("User Content"):
- You remain the owner of your User Content
- You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content only as needed to operate, improve, and provide the Service (including sharing features you enable)
- You represent that you have the rights to upload the content and it does not violate law or third-party rights
6. Prohibited Content and Conduct
You must not use the Service to:
- Upload or share illegal content, hate/harassment, sexual exploitation (especially involving minors), extremist content, or content infringing IP rights
- Collect personal data unlawfully, dox others, or share sensitive data without lawful basis/consent
- Attempt unauthorized access, scraping, reverse engineering (except where allowed by mandatory law), malware distribution, or interference with the Service
- Impersonate others or engage in fraud
7. Community Safety and Reporting (Notice & Action)
If the Service enables sharing/hosting of User Content, we provide a mechanism to report content you believe is illegal or violates policies. We will review reports, take action where appropriate (e.g., removal/restriction), and may offer an appeal route depending on the context. This section is designed to align with EU online safety expectations.
8. Subscriptions, Pricing, and Billing
If you purchase a Subscription:
- Plan features, limits, and prices are shown at checkout and/or on the pricing page, including whether prices include VAT (if applicable)
- Subscriptions may renew automatically unless canceled
- You can cancel through your account settings or the platform you used to subscribe (e.g., Apple/Google/Stripe portal)
- If you cancel, you keep access until the end of the current billing period (unless mandatory law requires otherwise)
- We may change pricing; if so, we'll notify you in advance and changes apply from the next renewal
9. Consumer Rights (EU/Bulgaria) – Right of Withdrawal (14 Days)
If you are a Consumer in the EU/EEA and you conclude a distance contract (online purchase), you generally have the right to withdraw within 14 days without giving a reason, subject to exceptions and conditions.
Digital content / digital service exception (important): If you purchase digital content or a digital service and you request immediate performance, you may lose the right of withdrawal once performance begins, provided you gave the legally required acknowledgments. How to withdraw: To exercise withdrawal, contact us at support@fapuli.com with: name, account email, order ID, date of purchase, and statement of withdrawal. If you are entitled to a refund under mandatory law, we will process it using the same payment method unless otherwise agreed.Bulgarian Consumer Protection Act confirms the 14-day withdrawal rule for distance contracts and its framework.
10. Refunds
Default rule: Unless required by mandatory law, subscriptions are non-refundable for partially used periods.If mandatory consumer law applies (including withdrawal rules above), refunds will follow those rules.
11. Intellectual Property
The Service (software, UI, logos, trademarks, and non-user content) is owned by us or licensors and protected by IP laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless permitted by law or written permission.
12. Third-Party Services
The Service may integrate third-party providers (e.g., payments, analytics, authentication, storage). Your use of those services may be governed by their own terms. We are not responsible for third-party services outside our control.
13. Privacy and Data Protection
Our processing of personal data is described in the Privacy Policy and related notices (cookies, analytics, etc.). These Terms incorporate the Privacy Policy by reference.
14. Availability, Changes, and Maintenance
We may modify, suspend, or discontinue parts of the Service, add/remove features, and perform maintenance. We will aim to provide reasonable notice when changes materially affect paid subscribers, where feasible.
15. Termination
You can stop using the Service at any time and may delete your account where offered. We may suspend or terminate access if:
- You violate these Terms or law
- It's necessary to protect the Service, users, or third parties
- Required by a competent authority
16. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation, or that learning outcomes will be achieved.
17. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages (loss of profits, data loss, etc.)
- Our total liability for claims related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, unless mandatory law requires otherwise
18. Complaints and Dispute Resolution
- Support/complaints: Contact support@fapuli.com. We will attempt to resolve complaints promptly
- Governing law: These Terms are governed by the laws of Bulgaria, unless mandatory consumer protection rules in your country of residence apply
- Courts: Unless mandatory law provides otherwise, disputes are subject to the competent courts in Sofia, Bulgaria
- EU ODR: If you are an EU consumer, you may also use the EU Online Dispute Resolution platform
19. Changes to These Terms
We may update these Terms. If changes are material, we will provide notice (e.g., in-app notice/email) and indicate the effective date. Continued use after the effective date means acceptance.
